DISPUTE:

Claim of Conductor C.J. Granger and crew, Hornepayne, Ontario, for freight rates of pay, Train MW2 on 2 April 1987.

JOINT STATEMENT OF ISSUE:

On 2 April 1987, Conductor Granger and crew worked Passenger Train MW2, from Hornepayne to Foleyet where the crew went off duty at 0320 hours 3 April 1987. For their tour of duty on Passenger Train MW2, Conductor Granger and crew were compensated at passenger rates of pay.

On 3 April 1987, for their return trip, Conductor Granger and crew worked in freight service, on Train 337, Foleyet to Hornepayne. For their tour of duty on Train 337, Conductor Granger and crew were compensated at freight rates of pay.

The Union contends that Conductor Granger and crew are entitled to payment at freight rates for their tour of duty on Passenger Train MW2, 2 April 1987, in accordance with Article 63.2 of Agreement 4.16.

The Company declines the Union's contention.
