CANADIAN RAILWAY OFFICE OF ARBITRATION

CASE NO. 3405

Heard in Montreal, Wednesday, 11 February 2004

concerning

CANADIAN NATIONAL RAILWAY COMPANY

and

UNITED TRANSPORTATION UNION

EX PARTE

DISPUTE:

Violation of article 57 of agreement 4.16. Implementation of an appropriate remedy consistent with the provisions of article 85, addendum 123 of agreement 4.16.

UNION'S STATEMENT OF ISSUE:

On November 7th, 2003, the Company issued a notice (#610) to all employees at Oshawa Yard advising that the recognized switching limits at Oshawa have been changed. This arbitrary change in the established switching limits is contrary to the provisions of article 57 of agreement 4.16.

It is the Union's position that the Company violated the reasonable intent of article 57 and, as a result, requested that an appropriate remedy be applied.

The Company declined the Union's request.
