LITIGE :

 

            The dismissal of Mr. Michel DeBlois for: “Your carelessness when you omitted to stop at two intersections and went over the 25km/h speed limit. Your actions resulted in a collision with the Dodge Ram you were driving and CP’s Dodge Dakota driven by Mr. Lévesque. You and Mr. Lévesque sustained major injuries and the accident caused property damage estimated at $100,000.

 

            These events occurred on July 13, 2010 while you occupied the position of driver at the St-Luc Car Compound and constitutes violations to the following rules and regulations: (a) Section I of General Safety Rules, article 1.b (Briefing sessions on work); (b) Section I, on Vehicle and Equipment (paragraph 9); (c) Section II, CC 16 Rule, paragraph 1 (on speed), 2 (on stops at intersections), 3 (no crossing zone); (d) Section III, Principles: Knowing the task and Methods of work at the St-Luc Car Compound; (e) Vehicles to take out, Item 4 and Note to Item 7.

 

EXPOSÉ CONJOINT DU CAS :

 

            On July 14, 2010 the Ram 250 truck driven by Mr. DeBlois collided with Company vehicle driven by Mr. Éric Lévesque. The accident happened at the car compound of the St. Luc Yard in Montreal. On July 14, 2010, Mr. DeBlois was held out of service pending a disciplinary investigation. On July 27, 2010 the Company held a disciplinary investigation with Mr. DeBlois concerning his work shift of July 13, 2010 from 21:30 – 05:30 of July 14, 2010 at the St. Luc Car Compound. On August 16, 2010 the Company dismissed Mr. DeBlois.

 

            The Union filed a grievance to appeal the dismissal of Mr. DeBlois and requested that Mr. DeBlois be reinstated into his position of driver as soon as possible, without loss of seniority. The Union claimed reimbursement of all lost wages and benefits since August 16, 2010.

 

            The Company denied the grievance.

SENTENCE ARBITRALE

 

            Pour les motifs exprimés dans la décision BAMCFC 4000, je considère que M. DeBlois méritait une discipline importante pour la collision des deux camions pendant son quart de travail le 14 juillet 2010. Cependant, je juge qu’il n’était pas aussi responsable que M. Lévesque pour les dommages qui ont été causés.

 

            Or, le grief est accueilli, en partie. J’ordonne que M. DeBlois soit réintégré dans ses fonctions, sans perte d’ancienneté et sans dédommagement de salaire et d’avantages sociaux. La période entre son congédiement et sa réintégration sera notée comme une suspension pour les évènements du 14 juillet 2010.
