Melnykowytch  following an extended period of absence that commenced in early 2009, Ms. Melnykowytch was cleared to return to work in March 2014. Prior to returning to work, recertification training was required. Upon unsuccessful passing of the signals exam she was informed that her employment file was closed. (COUNSEL)

Nenasheff for failure to verbally communicate and confirm that the hand operated switch associated with his crew’s work activities was properly lined and locked for the route to be used resulting in the Ogden Auto Compound Track 5/6 Switch being run through and the subsequent derailment of the “A” end of Car TTGX 990279. Dispute between CPR and TCRC-CTY-W concerning the assessment of 25 demerits and subsequent discharge  of Conductor D. Gaymer, the 25 demerits were assessed for the failure to immediately report the injury sustained to his left knee while working the A62-12 called for August 12, 2013 as outlined in GOI section 2 item 1. Discharge followed for the failure to respect the restrictions listed on his Functional Abilities Form (FAF) as evidenced by his engaging in activities outlined in the FAF as well as the failure to properly represent the current condition to his physician.
