Dispute between CNR and TCRC-LE concerning the discharge and following incidents for Mr. Bugoy :

·         Written reprimand for failure to protect the working board on December 12 to December 18, 2011.

·         5 day suspension for violation of speeding while operating trains, with a pending suspension from 2003/12/08, if anything happened in the next 6 months. Employee was off work from 2004 to summer of 20111 and had not worked 6 months prior to this incident.

·         7 day suspension for failing to comply with GOI Section 8, Safety Rules, Part 4.3 Personal Protective Equipment, resulting in delay, and attempting to mislead a Company Officer on September 17, 2012.

·         30 day suspension for missed calls for work on October 19th, 31st and November 18, 2012 and failure to properly protect his turn on the LE working board.

·         Discharge for violations of CROR Rule 439, CROR Rule 564(a), and CROR Rule 34 and 35 while operating a locomotive on June 26, 2013. (COUNSEL)
