4320	Dispute between CNR and TCRC-LE concerning the discharge and following incidents for Mr. Bugoy : · Written reprimand for failure to protect the working board on December 12 to December 18, 2011. · 5 day suspension for violation of speeding while operating trains, with a pending suspension from 2003/12/08, if anything happened in the next 6 months. Employee was off work from 2004 to summer of 20111 and had not worked 6 months prior to this incident. · 7 day suspension for failing to comply with GOI Section 8, Safety Rules, Part 4.3 Personal Protective Equipment, resulting in delay, and attempting to mislead a Company Officer on September 17, 2012. · 30 day suspension for missed calls for work on October 19^th, 31^st and November 18, 2012 and failure to properly protect his turn on the LE working board. · Discharge for violations of CROR Rule 439, CROR Rule 564(a), and CROR Rule 34 and 35 while operating a locomotive on June 26, 2013. 4321	Dispute between CNR and USW-LOCAL 2004 concerning the assessment of 20 demerits to M. Ferreira’s discipline record for the failure to safely operate a CN vehicle on August 24, 2013 resulting in damage to the vehicle when it struck a post.
4322	Dispute between CNR and USW-LOCAL 2004 concerning the discharge of M. Ferreira for the accumulation of over 60 demerit points.
4323	Dispute between CNR and USW-LOCAL 2004 concerning the discharge of Steel Bridge Worker B. Holland for unauthorised absence since October 2012 and failure to protect his assignment.
4324	Dispute between CNR and USW-LOCAL 2004 concerning the discharge of Permanent Machine Operator C. Wesley for the unauthorized use of company equipment and contractor equipment and contractor, performance of non-work related activities on Company time, unauthorized removal of CN material from company property for personal use, theft of fuel, during the month of September 12, 2013.

O’Brien for failure to work safely and in a manner compatible with those expected of a safety critical employee as evidenced by the multiple reports received by the Company from fellow crew members relating to his performance, while employed between the period of August 20, 2012 and November 11, 2012. 4328	Dispute between CPR and TCRC-LE concerning the discharge of Locomotive Engineer A. for conduct unbecoming an employee for engaging in use of illegal and prohibited substance (cocaine) as evidence by positive test result conducted on Dec. 27, 2012. (COUNSEL).
4329	Dispute between CPR and TCRC-MWED concerning the dismissal of K. in two parts first for the assessment of 30 demerits for his alleged failure to operate a spreader safely resulting in a collision between the spreader and a signal.  Second for a violation of Rule G as evidenced by positive test results. Both matters previously grieved, dispute concerning the decision to dismiss. (COUNSEL)
